الطبيعة القانونية للوصية الواجبة The Natural Legacy Of Mandatory Recommendation

الملخص: تتناول هذه الدراسة الوصية الواجبة من حيث طبيعتها القانونية و ذلك بالتفرقة بين كونها ميراثا تحكمه قواعد الإرث، أو اعتبارها وصية تخضع لأحكام الوصايا، وذلك من خلال الحديث عن أوجه الشبه والاختلاف بالنسبة للوصية الواجبة مع كل من الميراث و الوصية العادية. لهذا كان لزاما التطرق لماهية الوصية الواجبة ليسهل فيما بعد وضع تكييف لها وهذا من خلال مطلبين. Abstract : This study concerns the mandatory recommendation according to its natural legacy and the difference between being a succession governed by inheritance rules or considering the will submitted to its provisions through talking about the points of similarities and the points of differences of the mandatory recommendation with the inheritance and the ordinary recommendation. For that, it is necessary to look into what is the obligatory legacy to make easy its conditioning through two chapters.
