إثبات الإدانة بالجنح والمخالفات في القانون الجزائري The Proof Of Condemnation For Misdemeanors Or Contraventions In The Algerian Law

يتعرض هذا البحث لبيان الأدلة القانونية لإثبات الإدانة بالجنح والمخالفات وكيفية استخدامها السليم قصد الوصول لإقرار معادلة صحيحة بين حق المجتمع وحق المتهم في الدفاع بالتعرض لبعض النقائص التي اعترت النظرية العامـة للإثبات الجنائي(المواد 212 حتى 238 من قانون الإجراءات الجزائية) وأدت عند التطبيق لإشكالات كثيرة بسبب الاختـلاف حول تأويل النص القانوني الواحد، ثم اقتراح ما نراه لذلك من حلول. Abstract: This article deals with means of proof of the condemnation for misdemeanors and contravention and their correct application in order to Access to approve the correct equation between the right of society and the right of the accused in the defense exposure to some shortcomings which have occurred in the general theory of the penal proof (Articles 212 till 238 Code of Penal Procedure) And in its application caused to many problematic because of disagreement on the interpretation of one legal text, and to propose what we are seeing of solutions.
