Affaire Dhina : La France joue les prolongations dans l'intérêt du régime d'Alger
5 avril 2012 ' Le 10 mai se tiendront les élections législatives en Algérie. Le Dr Mourad Dhina, opposant politique de longue date au régime algérien, aurait joué un rôle important dans les débats et discussions autour de cette élection, mais la justice française semble en avoir décidé autrement.
La Présidente de la chambre d'instruction de la cour de Paris a décidé hier d'ordonner un complément d'information et de renvoyer l'affaire au 6 juin 2012, prolongeant ainsi d'autant la détention du Dr Dhina, ce qui a de quoi donner des motifs de satisfaction au régime d'Alger dont l'objectif principal était de neutraliser un opposant actif, au moins pendant la durée de la période électorale à venir.
Le comité FreeMourad s'étonne de cette décision, alors même que la magistrate en charge du dossier avait relevé, lors de l'audience du 21 mars, que ni le mandat d'arrêt, ni la demande d'extradition adressés par l'Algérie n'étaient conformes à la convention bilatérale d'extradition de 1964 et ne comportaient notamment ni la date ni les lieux des faits. L'avocat général avait, au cours de cette audience, lui-même ajouté que « force est de constater qu'un certain nombre d'obligations ne sont pas respectées, la première qui parait la plus évidente est de savoir quel est l'objet de la demande ».
Me Antoine Comte, l'avocat du Dr Dhina, avait clairement relevé le fait que la justice algérienne n'avait pas été en mesure de fournir les documents nécessaires deux mois après l'arrestation de son client. Il a également soulevé le fait qu'une enquête de la police helvétique ouverte à la demande des autorités algériennes, qui a duré de 1994 à 2000, avait été classée en raison de l'absence de tout fondement des accusations portées contre le Dr Dhina.
Cette décision de la cour de Paris semble donc incompréhensible, sinon à donner crédit à tous ceux qui, en Algérie, dans le monde arabe et en Europe dénoncent l'instrumentalisation de la justice française par le régime d'Alger et la collusion entre la majorité au pouvoir en France et le régime algérien pour museler une personnalité politique qui appelle à l'établissement d'une véritable démocratie et d'un état de droit dans son pays.

France again prolongs Dr Dhina's detention, playing into the hands of the Algerian regime
5 April 2012 ' On 10 May, Algeria will hold legislative elections. Dr Mourad Dhina, a long running critic and opponent of the Algerian regime, would have played a crucial role in the debates and discussions surrounding these elections, had the French judiciary not decided otherwise.
The president of the Paris Appeals Court yesterday decided to request complimentary information from the Algerian authorities and set the next hearing for 6 June 2012, prolonging Dr Dhina's detention for a further 2 months. Such a move surely gives great satisfaction to the Algerian regime whose principal objective in requesting Dr Dhina's extradition was to silence an active political opponent, at least during the upcoming electoral period.
The FreeMourad Committee is astonished by the judge's decision, knowing that she had herself pointed out, during the hearing 2 weeks ago on 21 March, that neither the arrest warrant nor the extradition request sent by Algeria was in conformity with the Franco-Algerian extradition convention of 1964 and that neither document contained dates or locations for the alleged offences. During this same hearing, even the general attorney had stated that, with regards to the file about Dr Dhina sent by Algeria, « a certain number of obligations are not respected. The first, which is the most obvious, is to know what the object of the request is. »
Mr Antoine Comte, Dr Dhina's lawyer, had also highlighted the fact that the Algerian judiciary had been unable to provide the required documents after more than 2 months of Dr Dhina's detention. He also reminded that an investigation carried out by the Swiss federal police from 1994 to 2000, originally launched at the request of the Algerian authorities, was closed after having found absolutely no basis for the accusations against Dr Dhina.
Today's decision by the Paris court therefore seems incomprehensible, unless it is seen through the paradigm increasingly held by many in Algeria, the Arab world and Europe, who firmly believe that French justice system is being used by the Algerian regime and who see deliberate collusion between the majority in power in France and the Algerian regime to suppress the voice of a leading political figure who is calling for a the establishment of a real democracy and the rule of law in his country.
